2.3. To register Yourself as a Practitioner You will be required to:
2.3.1. Furnish Your mobile number; 2.3.2. Provide Your name and surname; 2.3.3. Provide Your Date of birth; 2.3.4. Provide Your Gender 2.3.5. Provide Your Registration number, Specialization & Year of expiry for Doctors 2.3.6. Provide Your Degree making you eligible to practice the Allied field of providing Health Services, Council & Year of Expiry for Allied HSPs. 2.3.7. Provide details of your Lab name, address, mobile number, email address and upload registration & license documents for lab along with expiry.
2.4. The information collected from you by HST may constitute ‘personal information’ or ‘sensitive personal data or information’ under the SPI Rules.
2.5. “Personal Information” is defined under the SPI Rules to mean any information that relates to a natural person, which, either directly or indirectly, in combination with other information available or likely to be available to a body corporate, is capable of identifying such person. The SPI Rules further define “Sensitive Personal Data or Information” of a person to mean personal information about that person relating to:
2.5.1. passwords;
2.5.2. financial information such as bank accounts, credit and debit card details or other payment instrument details;
2.5.3. physical, physiological and mental health condition;
2.5.4. sexual orientation;
2.5.5. medical records and history; lifestyle, food preferences, medical conditions (if any), health goals or other
fitness regimes
2.5.6. biometric information;
2.5.7. information received by body corporate under lawful contract or otherwise;
2.5.8. visitor details as provided at the time of registration or thereafter; and
2.5.9. call data records;
2.5.10. Your IP Address;
2.5.11. Your location unless you deactivate location services in the relevant section of the Website/App;
2.5.12. What device you use to access the Website/App and its details (model, operating system, etc.);

2.7. Upon entering of mobile number by the End User/Doctor/Allied HSP an OTP OTP (One Time Password) shall be sent. For Labs, upon entering details of mobile number and email address, an OTP shall be sent to both for verification. An End User Account shall be registered by HST only upon the submission of such OTP by You (“Mobile Verification”).
2.8. End users shall be registered immediately after providing the correct OTP. Practitioners shall receive a confirmation of registration only after the necessary documents with respect to medical council/registration certificates/licenses are verified by HST and such other registration procedures mentioned in EULA.
2.9. HST operates on a freemium model, to access certain advanced features linked with the App, the subscribers would need to take subscriptions of various plans as enlisted hereinafter by making requisite payment, mode specified herein-above.
2.10. Any information that is freely available or accessible in the public domain or furnished under the Right to Information Act, 2005 or any other law for the time being in force shall not be regarded as sensitive personal data or information for the purposes of Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.
2.11. HST will be free to use, collect, and disclose information that is freely available or accessible in the public domain without Your consent.
2.12. All information provided by the user to HST including personal information or sensitive personal data or information is voluntary and that You hereby consent to such collection and use of information by HST.
2.13. HST shall not be responsible in any manner for the authenticity of the personal information or sensitive personal data or information supplied by the User to HST.
2.14. Without prejudice to the generality of the above, information collected by us from You may include (but is not limited to) the following:

3.1. PATIENTS/SUBSCRIBERS :
3.1.1. Accordingly, a condition of each Subscribers use of and access to the Services is their acceptance of the EULA, which also involves acceptance of the terms of this Privacy Policy. Any User that does not agree with any provisions of the same has the option to discontinue the Services provided by HST immediately.
3.1.2. All the information provided to HST by a Subscriber, including Personal Information or any Sensitive Personal Data or Information, is voluntary. You understand that HST may use certain information of yours, which has been designated as Personal Information or ‘Sensitive Personal Data or Information’ under the SPI Rules, (a) for the purpose of providing you the Services, (b) for commercial purposes and in an aggregated or non-personally identifiable form for research, statistical analysis and business intelligence purposes, statistical or intelligence data in an aggregated or non-personally identifiable form to third parties and affiliates (c) for communication purpose so as to provide You a better way of booking appointments and for obtaining feedback in relation to the Practitioners and their practice, (d) debugging customer support related issues (e) for the purpose of contacting you to complete any transaction if you do not complete a transaction after having provided us with your contact information in the course of completing such steps that are designed for completion of the transaction (f) for translation of documents as uploaded (g) for providing health analytic (h) for analyzing crash data. HST also reserves the right to use information provided by or about the Subscriber for the following purposes:
3.1.2.1. Publishing such information on the Website/App either on personalized page of Subscriber.
3.1.2.2. Contacting Subscribers for offering new products or services or for any other communication either for
following up on an appointment or as the case maybe.
3.1.2.3. To communicate about existing or new offers, content, advertisements, surveys, key policies or other
administrative information;
3.1.2.4. Analyzing software usage patterns for improving product design and utility.
3.1.2.5. Analyzing anonymized practice information for commercial use.
3.1.2.6. To use this data to enable Subscribers to make payments for HST subscriptions. We use a third-party service
provider to manage payment processing. This service provider is not permitted to store, retain, or use information
Subscribers provide except for the sole purpose of payment processing on behalf of HST;

regimes.

Personal Data or Information’ under the SPI Rules requires Subscribers express consent. By affirming your assent to this

3.1.5. HST does not control or endorse the content, messages or information found on any Services which are posted by
Users and, therefore, HST specifically disclaims any liability with regard to the Services and any actions resulting
from Subscribers participation in any Services, and Subscribers agree that you waive any claims against HST relating to
same, and to the extent such waiver may be ineffective, Subscribers agree to release any claims against HST relating to
the same.
3.1.6. Subscribers are responsible for maintaining the accuracy of the information you submit to us, such as your
contact information provided as part of account registration. If your personal information changes, you may correct,
delete inaccuracies, or amend information by making the change on our member information page or by contacting us
through info@healthsafetoday.com. We will make good faith efforts to make requested changes in our then active databases
as soon as reasonably practicable. If you provide any information that is untrue, inaccurate, out of date or incomplete
(or becomes untrue, inaccurate, out of date or incomplete), or HST has reasonable grounds to suspect that the
information provided by you is untrue, inaccurate, out of date or incomplete, HST may, at its sole discretion,
discontinue the provision of the Services to you.

Services is active and as needed to provide you the Services. We shall not retain such information for longer than is

on Platform for subscription amount(s) as mentioned on EULA. HST uses standard and authorized payment services along
with Health Safe Coins as enlisted herein and HST credit check and fraud prevention policies are aligned as per acceptable
standards. HST will collect such User’s credit card number and/or other financial institution information such as bank
account numbers and will use that information for the billing and payment processes, including but not limited to the
use and disclosure of such credit card number and information to third parties as necessary to complete such billing
operation. Verification of credit information, however, is accomplished solely by the User through the authentication
process. User’s credit-card/debit card details are transacted upon secure sites of approved payment gateways which are
digitally under encryption, thereby providing the highest possible degree of care as per current technology. However,
HST provides you an option not to save your payment details. Users are advised, however, that internet technology is not
full proof safe and User should exercise discretion on using the same.
3.1.11. This Privacy Policy applies to Services that are owned and operated by HST. HST does not exercise control over

3.1.15. HST has implemented best market practices and security policies, rules and technical measures to protect the

to the User’s electronic devices through which the User avails the Services, HST shall not be held liable for any loss

3.2.1. This section applies to all Practitioners. As part of the registration as well as the application creation and
submission process that is available to Practitioners on HST, certain information, including Personal Information or
Sensitive Personal Data or Information is collected from the Practitioners as enlisted in Clause 2 hereinabove.
3.2.2. All the statements in this Privacy Policy apply to all Practitioners respectively, and all Practitioners are
therefore required to read and understand the privacy statements set out herein prior to submitting any Personal
Information or Sensitive Personal Data or Information to HST, failing which they are required to leave the Services,
including the Website immediately.
3.2.3. Practitioners’ personally identifiable information, which they choose to provide to HST, is used to help the
Practitioners describe and identify themselves. This information is exclusively owned by HST, You will be the owner of
your information and you consent to HST collecting, using, processing and/or disclosing this information for the
purposes hereinafter stated. HST may use such information for commercial purposes and in an aggregated or non-personally
identifiable form for research, statistical analysis and business intelligence purposes, and may sell or otherwise
transfer such research, statistical or intelligence data in an aggregated or non-personally identifiable form to third
parties and affiliates. HST also reserves the right to use information provided by or about the Practitioner for the
following purposes:
3.2.4. Practitioners’ personally identifiable information, which they choose to provide to HST, is used to help the
Practitioners describe and identify themselves. This information is exclusively owned by HST, You will be the owner of
your information and you consent to HST collecting, using, processing and/or disclosing this information for the
purposes hereinafter stated. HST may use such information for commercial purposes and in an aggregated or non-personally
identifiable form for research, statistical analysis and business intelligence purposes, and may sell or otherwise
transfer such research, statistical or intelligence data in an aggregated or non-personally identifiable form to third
parties and affiliates. HST also reserves the right to use information provided by or about the Practitioner for the
following purposes:
3.2.4.1. Publishing such information on the Website/App.
3.2.4.2. Contacting Practitioners for taking product feedback/feedback or for service rendered.

HST automatically enables the listing of Practitioners’ information on its Website/App. The Practitioner information listed on Website is displayed when End-Users search for Practitioners’ on Website, and the Practitioner information listed on Website is used by End-Users to request for Practitioners’ appointments/service. Any personally identifiable information of the Practitioners listed on the Website is not generated by HST and is provided to HST by Practitioners who wish to enlist themselves on the Website/App, or is collected by HST from the public domain. HST displays such information on its Website on an as-is basis making no representation or warranty on the accuracy or completeness of the information. As such, we strongly encourage Practitioners to check the accuracy and completeness of their information from time to time, and inform us immediately of any discrepancies, changes or updates to such information. HST will, however, take reasonable steps to ensure the accuracy and completeness of this information. HST does not undertake any liability for any incorrect or incomplete information appearing on the Website/App for such Practitioners.
3.3. VISITORS
3.3.1. No sensitive personal data or information is automatically collected by HST from any casual visitors of this
website, who are merely perusing the Website. HST may however collect the following, Your IP Address; Your location; How
you behave on the Website, (what pages you land on, how much time you spend, etc.);What device you use to access the
Website and its details (model, operating system, etc.); and Cookies and web beacon data.

as mentioned in Clause 4.1, while making sure that only permitted personnel have access to it for performing certain
necessary and essential tasks.
4.3. HST assists patients and helps access information related to them. HST may, therefore, retain and submit all such
records to the relevant patients, or to their Practitioner.
4.4. Your account information (e.g., email address, password) will be encrypted as soon as You register over HST App,
and we store and process such encrypted information in India .
4.5. HST uses commercially reasonable safeguards and takes reasonable steps to keep the information encrypted at all
times so that the information will not be decrypted and accessible.
4.6. HST takes reasonable steps to keep the information of its users safe.
4.7. HST will store and process Personal Information including any sensitive personal information collected (defined
under the IT Act, 2000, as permitted by prevalent laws in India), on secured cloud servers Amazon Web Services of HST.
4.8. You hereby authorize HST to use and/or share Anonymized Data with advertisers and other third parties for the
purpose of building data science analytics, marketing and promotions.

4.12. All personal medical documents uploaded by Subscribers including but not limited to X-rays and/or other personal
medical images/documents are intended to aid and assist a medical practitioner. However, HST in no way guarantees that a
medical practitioner will take all such medical documents into consideration before issuing an opinion and HST is not in
any way responsible for the outcome in relation to the aforesaid or for any transcription of prescriptions as uploaded
by the subscriber.
4.13. HST makes no representations or guarantees that the Platform will be free from loss, destruction, damage, any
unauthorized access to or use of HST’s secure servers and/or any and all personal information stored therein,
corruption, attack, any interruption or cessation of transmission to or from the Platform, any bugs, viruses, Trojan
horses, or the like which may be transmitted to or through the Platform by any third party, and/or any errors or
omissions in any content or for any loss or damage of any kind incurred as a result of the use of any of the Content
accessible via the Platform.
4.14. HST does not warrant, endorse, guarantee, or assume responsibility for any service advertised or offered by a
third party/user through the services and HST will not be a party to or in any way be responsible for monitoring any
transaction or communication between You and/or third-party providers/users or services.
4.15. As with purchase of a service through any medium or in any environment, You should use Your best judgment and
exercise caution. Interference, personal injury, or property damage, of any nature whatsoever, resulting from Your
access to and use of the Platform, hacking, or other security intrusions, HST disclaims any liability relating thereto.
4.16. HST, on whose computer resource, the stated information is stored, hosted or published, upon receiving actual
knowledge in the form of an order by a court of competent jurisdiction or on being notified by the Appropriate
Government or its agency under clause (b) of sub-section (3) of section 79 of the IT Act, shall not host, store or
publish any unlawful information, which is prohibited under any law for the time being in force in relation to the
interest of the sovereignty and integrity of India; security of the State; friendly relations with foreign States;
public order; decency or morality; in relation to contempt of court; defamation; incitement to an offence relating to
the above, or any information which is prohibited under any law for the time being in force:
4.17. HST shall, upon receiving actual knowledge, on a voluntary basis on violation of aforementioned clause, shall
preserve information and associated records for one hundred and eighty days (180) for investigation purposes, or for
such longer period as may be required by the court or by Government agencies who are lawfully authorised; Your profile
may be deleted by us by informing You 24 (twenty-four) hours in advance without warning, or without any notice
whatsoever, if we believe that You have violated any of the conditions as mentioned under this Agreement or the Privacy
Policy or any other Agreement of HST. HST also reserves the right to refuse access to the website, terminate Your
account or membership or remove any content at any time without notice to You, subject to the other provisions of this

evaluation or treatment due to failures of electronic equipment; a lack of access to Your medical records; accuracy of
transcription reports as provided by Amazon Textract AWS, Comprehend Medical and Human Augmentation.You accept to ensure
and recheck details of such transcriptions as added upon, by use of aforementioned. If any discrepancy with respect to
information listed based on transcriptions, you shall manually correct the same immediately and send us a feedback on
email address as mentioned in these Terms, at the earliest. You take full responsibility for ensuring that any
information that You submit is complete and accurate and understand that the medical practitioner relies solely on the
information provided by You.
11.3. We shall not be responsible for any errors in transmission or for the corruption or compromise of any information
communicated over the Platform. Thus, before sharing any information or acting on any information or advice offered to
You by or through the Platform, You should confirm that You have understood and accept the associated limitations and
risks and agree that You are not using the Platform as a substitute for consultation with Your primary care physician.
11.4. No patient information would be disclosed to any service provider without the prior approval and consent of the
patient. HST has put in place procedures and technologies as per good industry practices and in accordance with the
applicable laws, to maintain security of all personal data from the point of collection to the point of destruction. Any
third-party data processor processing such information on behalf of HST shall have to agree to comply with such
procedure and policies or put in place adequate measures of its own.
11.5. Notwithstanding anything, HST is not responsible for the confidentiality, security or distribution of Your

third-parties. Further, HST shall not be responsible for any breach of security or any actions of third parties or
